The data protection statement listed here complies with the guidelines of the DSGVO and the BDSG. It is intended to inform you about the nature, purpose and use of personal data by me, the website owner Frank Siegert.

Note: The 'Datenschutz-Grundverordnung', the 'DSGVO' is also called 'General Data Protection Regulation' (GDPR) in English. The German name 'DSGVO' is used throughout this text.

Although my site is equipped with various security measures, complete protection of your personal data can not be guaranteed since security gaps can not be ruled out. Therefore I have minimized the data collection. If you have concerns regarding the collection of your personal data, you will find at the end of the text the corresponding contact information from me as a contact person.

2. Personal data

Personal information is information about your identity. These include e.g. Information such as name, address, telephone number, or e-mail address. Even your IP-Address could be used to trace back your identity.

In advance - visiting of my web pages and downloading files are possible without providing personal data. Your internet address (the so called "IP-Address") transmitted during access will only be used by my web server to deliver the content to you and will then be discarded immediately.

The function and the communication of my service relies on data of my users. Personal data is particularly sensitive - meaning all information that can be clearly attributed to a specific, natural person. According to the DSGVO, I have an obligation to list the entire scope of all such data:

3. How I collect personal information:

- When contacted via the provided e-mail address the data will be processed and stored as described in section 3.8 of this privacy policy.

- If you place an order through my e-commerce partner Digital River GmbH, the data listed under section 5 of this privacy policy will be forwarded to me and stored by me.

In particular:

3.1. No log files

A log file is not written by my web server. Colloquially said: I do not store who, when, with what or from where visited which pages.

Through my provider Fa. Hetzner GmbH and if redirected from by Fa. 1&1 Internet, it may come in the event of an error, attack, disruption or analysis of a network failure to a temporary logging of access to this server. In this case the time, date and IP address may be logged. This protocol is created anonymously, whereby parts of the IP addresses are exchanged by random numbers - an assignment to a person or network end point is therefore no longer possible. After problems have been resolved, such an anonymous log will be deleted immediately. Contracts for processing ('Auftragsverarbeitungvertrag') pursuant to Art. 28 DSGVO exist.

3.2. No cookies

Cookies are small datasets in file form, which are transferred to your web browser, stored there and which can be used to restore settings already made during your next visit and any other changes you have made.

3.9. Contact via the provided e-mail address

If you send me an e-mail via the provided e-mail address any personal data transmitted by e-mail is stored. There is no disclosure of the data to third parties, it is used exclusively for answering in the conversation. The legal basis for the processing of the data in this case is DSGVO Art. 6 para. 1 lit. f. and addtional DSGVO Art. 6 para. 1 lit. b if the e-mail conversion is aiming at a conclusion of contract. In case of a contact by e-mail the required legitimate interest is answering your questions and inquiries. The data will be deleted as soon as the purpose of their collection are no longer necessary. For personal data sent by e-mail, this is the case when the conversation with the user has ended, no legitimate interest and no legal storage obligation exists. The conversation is finished if it can be inferred from the circumstances, that the request was fully answered. Whoever person send me e-mail always can withdraw the consent to the processing of personal data at any time. In such a case, the conversation will not continue. The technical and organisational measures described in section 5. also apply to e-mails.

If you wish to contact me by e-mail, I would like to point out that the confidentiality of the submitted information is not guaranteed for unencrypted e-mails. The content of unencrypted e-mails can be viewed by third parties. I therefore recommend that you send me confidential information either as an encrypted e-mail or by post.

4. Your rights

Of course you have rights in relation to the collection of your data. Under current law, I am required to educate you about them. The use and implementation of these rights is free of charge for you.

Under the DSGVO, you are entitled to the following legal rights, provided that their requirements are met:

Right to access

You have the right to ask for confirmation as to whether personal data relating to you are being stored or processed, the scope / categories of such data, processing purposes, recipients of such data, planned duration for which your personal data are stored, automated decision making including profiling. If your data are transmitted to a third country or to an international organization, you have the right to be informed of the appropriate guarantees in connection with the transfer. You have the right to request a copy of all your personal data stored.

5. Scope of processing of personal data when placing an order

e-Commerce Partner Digital River GmbH

On my website software programs created by me are offered for free and anonymous download. Some of these software programs are intended as test versions for those interested and write by default a visible 'watermark' in their output, e.g. visually mark the generated result with reference to a test output. This way these programs can be tested anonymously by the interested party if they match their needs and work as intended in their specific environment. In order to remove the watermark, a license may be purchased along with a so-called 'unlock code', which removes the watermark and allows use for other than test purposes. Since direct marketing has become difficult in the current times due to the large number of payment options and complex tax requirements, I work with a partner company, which carries out the sale of individual licenses. B2B customers can also contact me directly for other licensing models, please use the e-mail address stated in the Legal Notice. Likewise I am available for other inquiries, e.g. design and implementation of solutions for special requirements at this address.

Orders are processed by my e-commerce partner Digital River GmbH. Digital River GmbH is part of the Digital River, Inc. group of companies, a leading provider of e-commerce sales services, and the authorized seller of products and services offered on the MyCommerce Share-it website. All personal data provided or recorded when visiting the MyCommerce Share-it website is controlled by Digital River GmbH, Scheidtweilerstraße 4, 50933 Cologne, Germany ("Data Controller").

Scope of data processing and legal basis

After placing an order, DigitalRiver GmbH will send you the information needed to put the product into operation. As part of my contractual relationship with DigitalRiver GmbH, I also receive a notification from DigitalRiver GmbH with the billing information for this order. The information provided to me includes your name and address, your e-mail address, the ordered product and the number ordered, phone and fax number (if supplied), if applicable your VAT ID no., as well as the method of payment without providing any account information or credit card information. These data are stored by me within the scope of the legal storage obligations (section 147 'Abgabenordnung' defines a storage obligation of 10 years, the data for completed sales are therefore kept by me 10 years). The data will be forwarded to my tax consultant / auditor and the responsible tax authorities within the framework of my bookkeeping / tax declaration. No other processing or transfer takes place. The legal basis is Art. 6 para. 1 lit. c DSGVO.

Technical and organisational measures

To protect your personal data, I have taken measures that comply with data protection law and the current state of technology. These are continuously reviewed and adjusted if necessary. The goal is to protect your data against accidental or intentional manipulation, loss and destruction, unauthorized acquisition and access by third parties. Furthermore, I protect my systems and processing paths by appropriate technical and organizational measures. These include data encryption, logical and physical access restriction and control, firewalls, recovery concepts, and integrity testing.
